PRIVACY AND PERSONAL DATA PROTECTION POLICY

In accordance with the provisions of Regulation (EU) 2016/679 (the General Data Protection Regulation), we provide the necessary information regarding the processing of personal data carried out through this Website.

1. DEFINITIONS

Legal Company means Limited Liability Company “LEGAL COMPANY “ACTA”, registered in accordance with the laws of Ukraine. Information about the Legal Company, including its location and other details, is publicly available information published in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations. The Legal Company is the controller of personal data.
Website means the website https://actalaw.com.ua/.Legal Services means the subject matter of the agreement between the parties, namely goods and/or services provided by the Legal Company.Personal Data Database means a named set of organised personal data in electronic form and/or in the form of personal data filing systems.Special Information and Materials means materials that directly or indirectly contain information regarding the Legal Services.
Acceptance means any of the following actions:● use of the Legal Company’s Website by viewing the materials and/or information posted on it;● written notification, including in electronic form by means of email, made by the User regarding acceptance of the terms of this Agreement.
Personal Data means information or a set of information about a natural person who is identified or can be specifically identified.
Processing of Personal Data means any action or set of actions, such as collection, registration, accumulation, storage, adaptation, alteration, renewal, use and dissemination, including distribution, sale or transfer, depersonalisation, or destruction of personal data, including through the use of information and automated systems.
Publicly Available Sources of Personal Data means directories, address books, registers, lists, catalogues, and other systematised collections of open information containing personal data that have been placed and published with the knowledge of the personal data subject.
Publicly Available Sources of Information means printed mass media, television and radio broadcasting media, pages on the Internet and/or created using the Internet, messenger accounts, social networks, Internet portals, public speeches, and other sources of information to which natural persons and legal entities have free access, unrestricted by applicable law, and/or access to which has been made open by the personal data subject.
Confidentiality of Personal Data means the mandatory requirement imposed on the Website Administration or any other person who has obtained access to personal data not to allow their dissemination or disclosure without the consent of the personal data subject or another lawful basis.
Cookies means a term used to describe information in the form of text or binary data received from the Website on a web server, stored by the client, namely the browser, and subsequently sent to the same website upon a repeated visit.
IP Address means a unique network address of a node in a computer network built on the IP protocol.

2. GENERAL PROVISIONS

2.1. Acceptance of the Agreement by the User means the User’s automatic and full consent to this Privacy and Personal Data Protection Policy hereinafter referred to as the “Policy”, as well as to the terms of processing of the User’s personal data.

2.2. If the User does not agree with the terms of the Policy, the User must stop using the Website and leave it immediately.

2.3. The Legal Company shall not be liable for the content and accuracy of the information provided by the User. Any actions performed for the registration of the User and/or performed using the User’s account and/or personal account shall be deemed to have been performed by this User.

2.4. The Legal Company shall not be liable for third-party websites that the User may access through links that may be available on the Website.

2.5. By accepting the Agreement, the User confirms that he or she has reached the appropriate age that allows him or her to independently enter into agreements and independently give consent to the processing of personal data.

2.6. If the Legal Company has doubts as to whether the User has reached the appropriate age, the Legal Company has the right to suspend the provision of Legal Services until the circumstances are established and/or refuse to provide Legal Services to the User.

2.7. By accepting the Agreement, the User voluntarily gives consent to the collection and processing of personal data for the following purposes:

1. identification of the User;
2. provision of access to the resources and information of the Website;
3. provision of access to the User’s Personal Account/Account;
4. communication with the User regarding Legal Services and processing of the User’s requests;
5. sending advertising and special offers, information about promotions or any other information about the activities of the Website and the Legal Company by means of communication, including email, mobile communication and the Internet;
6. determining the User’s location to ensure security and prevent fraud;
7. development and improvement of the quality of Legal Services.

The User’s personal data may also be used for other commercial purposes of the Legal Company that are not provided for by this Privacy Policy, provided that such purposes fall within the scope of the Legal Company’s activities.

2.8. The Website Administration is obliged not to disclose and to ensure the protection and confidentiality regime of the User’s personal data provided by the User at the request of the Administration and/or when filling out a form.

2.9. Personal data is provided by the User by submitting information and responses on the Website, as well as during the use of the Website, and may include the following information:

1. full name of the User;
2. age of the User;
3. gender of the User;
4. contact telephone number of the User;
5. photographs of the User;
6. email address of the User;
7. User’s logins on the Internet, including accounts, messengers, etc.;
8. other confidential data about the User.

In addition to the data specified above, the Website Administration reserves the right to automatically collect the following data while the User views the Website, for the purpose of determining the development paths of the Website and areas for improving the provision of Legal Services:

1. IP address of the User’s electronic computing device, including computer, phone, tablet, etc.;
2. information about Cookies stored in the User’s browser;
3. information about the User’s electronic computing devices, including computer, phone, tablet, etc.;
4. information about the User’s browser, including its name, browser version, etc.;
5. time of access to the Website;
6. addresses of the Website pages viewed by the User;
7. addresses of previous pages from which access to the Website was obtained.

Disabling the Cookie collection function by the User may make it impossible to access certain parts of the Website. The Legal Company shall not be liable for the inability to use the Website if the Cookie collection function is disabled.

2.10. The User’s personal or confidential information specified above shall be stored and shall not be disseminated, except upon requests from competent authorities and/or only in the cases and in the manner established by law.

2.11. In the event of loss or disclosure of Personal Information, the Website Administration and the Legal Company shall not be liable if such information:

1. became or was public at the time of loss or disclosure;
2. became available or was posted in Publicly Available Sources of Information;
3. was received from a third party before it was received by the Website Administration;
4. was disclosed with the User’s consent;
5. was disclosed by the User;
6. was disclosed by another person in relation to the User.

2.12. The User undertakes not to disclose or disseminate confidential information of the Legal Company and other Users that was obtained by the User in the course of using the Website. All information regarding Legal Services, Special Materials, the Website, information, materials, consultations and resources posted on the Website and/or obtained by the User while using the Legal Services, as well as other data that became known to the User, including but not limited to during the use of chat, shall be considered confidential. The User has no right to transfer confidential information to third parties.

2.13. In the event of the User’s failure to comply with the requirements specified in clause 2.12, if this results in the disclosure of confidential information, the User shall be liable in the manner established by law and shall compensate the Legal Company, or the owner of such confidential information if the owner is a person other than the Legal Company, for all losses incurred in full.

2.14. The processing of the User’s personal data shall be carried out without limitation of time, by any lawful means, including in personal data information systems using automation tools or without the use of such tools.

2.15. The Website Administration shall take the necessary organisational and technical measures to protect the User’s personal data from disclosure. The Website Administration shall use the User’s personal data exclusively for the purpose or purposes provided for by this Policy.

2.16. The User’s rights regarding his or her personal data are defined by the Law of Ukraine “On Personal Data Protection”.

2.17. The Privacy Policy shall enter into force from the moment it is posted on the Website.

2.18. The Website Administration has the right to independently amend and/or supplement the terms of this Policy. Such amendments and supplements shall enter into force from the moment they are displayed on the Website.

2.19. This Policy shall be governed by the provisions of the applicable legislation of Ukraine.
